SUMMARY:

With the popularization of the internet and the dissemination of information technology as a commodity, there was a progression of human relationships, which previously only existed in a physical environment, to the digital environment. Digital transformation has also changed interpersonal relationships in such a way that new challenges have emerged regarding the mission of guaranteeing human, civil and constitutional rights in the virtual environment. Due to this transformation, a highly relevant problem emerged: the violation of people's privacy in the computerized environment. Among the forms of violation, this work focuses on Surveillance Capitalism, which consists of the procedure where expert algorithms collect, monitor and analyze behavioral data from users in order to profile them - preparing the user's behavioral profile. Thus, the behavioral profile is used, among other purposes, to predict products, services, marketing campaigns, in addition to triggering influence actions designed specifically to persuade the user. The acceleration of the adoption of Distance Learning (EAD) boosted the adoption of Virtual Learning Environments (VLE) - internet teaching systems that offer a range of educational resources to support EAD education. These systems are still deficient in personal data protection compliance and, therefore, susceptible to privacy violations. Thus, this work is based on international personal data protection standards ISO/IEC 27701, ISO/IEC 29100, ISO/IEC 29134 and specific Brazilian legislation, the General Personal Data Protection Law (LGPD), Law n. 13,709, of August 14, 2018, to propose a framework of technical requirements to be met by AVAs. The requirements aim to promote the protection of users' personal data in a digital educational environment, in addition to contributing to data privacy compliance with the regulations in force in Brazil, the LGPD. Finally, the framework is tested and validated against Moodle, the most used AVA globally, with the purpose of evaluating its effectiveness in diagnosing personal data protection non-compliances on an AVA.
